Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of Atomic BI's Hyper-Personalised Outreach solution (the “Service”). By clicking “I Accept” or by using the Service, you agree to be bound by these Terms. If you are accepting on behalf of your employer or another entity, you represent that you have the authority to bind that entity.

2. Definitions

  • Atomic BI: Atomic BI PTE. LTD., incorporated in Singapore. Registered office: 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore, 068914.
  • Client: The individual or entity that has purchased access to the Service.
  • Service: Atomic BI's Hyper-Personalised Outreach solution, including all software, tools, and features.

3. Service Description

Atomic BI provides a Hyper-Personalised Sales Outreach productivity solution powered by AI and Automation. Available in two options: Do-It-Yourself and Done-For-You.

Floating Licences: User Licences are purchased as floating seats. The Client may transfer a licence from one individual to another within their organisation at any time, provided the total number of active users does not exceed purchased licences.

4. Done-For-You Service

  • Rolling monthly subscription, terminable with 30 days written notice
  • Up to 20 connection requests and 25 InMail messages per working day per LinkedIn account
  • Additional LinkedIn accounts available for an additional fee
  • Prospect responses responded to within 1 business day

5. Payment Terms

Payments due within 14 days of invoice date. Late payments: 1.5% administration fee per month on outstanding amount. Service commences upon receipt of initial payment.

Money-Back Guarantee: 30-day money-back guarantee on the first month of service, subject to fair usage. To qualify, the Client must demonstrate minimum 30 minutes of usage per business day during the 30-day period.

6. Intellectual Property

All intellectual property rights in work created by Atomic BI are owned exclusively by Atomic BI. The Client is granted a personal, worldwide, royalty-free, non-assignable, non-exclusive licence to use the software.

Client Data Ownership: The Client retains all rights, title, and interest in and to all data, leads, prospect information, and message history generated or processed through the Service using the Client's LinkedIn account.

7. Client Obligations

  • Respond to Atomic BI requests in a timely manner
  • Designate a project coordinator as primary point of contact
  • Ensure use complies with all applicable laws and regulations
  • Provide accurate and complete data

8. Confidentiality

Each party shall maintain confidentiality of all confidential information. Confidential information shall not be disclosed to third parties without prior written consent. Obligations survive termination for 3 years.

9. Liability Limitation

Atomic BI's total liability is limited to the total amount paid by the Client for the Service. Neither party shall be liable for indirect, incidental, special, consequential, or punitive damages.

10. Data Protection

Atomic BI implements appropriate technical and organisational measures to protect personal data. We comply with relevant data protection regulations including GDPR. Security measures include end-to-end encryption, RBAC, and secure authentication (OAuth 2.0, SSO).

11. Service Level Agreement

99% availability target, excluding scheduled maintenance. Support requests responded to within 24 hours during business days.

12. Termination

Either party may terminate with 30 days written notice. Atomic BI may terminate immediately upon material breach. Upon termination, Client ceases use and pays outstanding fees.

13. Governing Law

These Terms are governed by the laws of Singapore. Disputes resolved through good faith negotiations, then arbitration in Singapore via SIAC. Language of arbitration: English.
